Appealing parking fines: Part 2 reasons for appeal

There are many reasons to appeal parking fines but make sure that you have a valid one before you start to go through the process as it may end up costing you more money and time by doing so.

There are many reasons for appealing parking fines, some of which are more obvious than others. The first reason for appeal is misleading or covered traffic signs which restrict parking. This is a common complaint and can be a successful one. The council must prove that it's clearly sign posted on every road entering the restricted parking area, otherwise they can't charge you for illegally parking as you were unaware it was.

Another common reason for appeal is the parking bay being too small. If you're fined for taking up two parking bays measure the size of the one you were parked in as if it isn't legally big enough they can't charge you for taking up two! In width the parking bay must be 1.62 metres from the outer of the first white line to the outer of the second.

If you had a valid ticket that had fallen out of view is another reason for appeal as long as you still have the parking ticket to prove that you had paid to park. Just send in the parking ticket with you letter of appeal and the parking fine will usually be revoked.

If it's not your car you can't be expected to pay the parking fine! Sometimes when you sell or buy a car it can take a few days to be registered to a different name, if someone receives a parking fine within that time it will be sent to the person the car is registered to and they may not be the owner anymore. Another scenario where you may not have committed the offence is if you own a leasing company and the car is registered in your name. In this instance all you have to do is state the details of the person who is leasing the car from you. If the car has been stolen and someone has committed a parking offence you can be expected to be responsible. This is a reason for appeal as it was your car but you didn't commit the offence and therefore can't be held liable. You will be asked to provide a crime reference number when you appeal to prove that the car was stolen.
